Simple Media Encoder is currently offered free of charge from this website at the copyright holder’s discretion. You may install and use it. You may not sell, sublicense, or redistribute copies. The copyright holder may charge for the software, or for future versions, at any time.

1. Ownership

Andreas Sørby (“Licensor”) owns all right, title, and interest in and to Simple Media Encoder, including its source code, object code, documentation, and branding (the “Software”), except for third-party components that remain subject to their own terms. All rights not expressly granted in this license are reserved by Licensor.

2. License grant

Provided you obtained the Software from Licensor’s official website or another channel Licensor designates, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable license to:

  1. install and use the Software on computers you own or control, for personal use or internal use within your organization; and
  2. make a reasonable number of copies solely for backup and archival purposes.

The Software is currently offered free of charge at Licensor’s discretion. Licensor may charge for the Software, or for future versions, or offer it under different terms, at any time.

3. Restrictions

Except as this license expressly allows, or as applicable law requires, you may not:

  1. sell, rent, lease, lend, sublicense, or otherwise commercially exploit the Software;
  2. charge a fee for copies of, access to, or use of the Software;
  3. distribute, publish, upload, or otherwise make the Software available to third parties, whether or not a fee is charged, including through an app store, file-sharing site, or bundle with other software or services;
  4. remove, obscure, or alter any copyright, trademark, or other proprietary notices;
  5. use Licensor’s names, logos, or trademarks except as needed to identify the Software truthfully; or
  6. use source code of the Software, if you have access to it, to create a competing product for sale or commercial distribution, or to distribute modified or unmodified copies of the Software.

You may view source code that Licensor makes publicly available, and you may modify the Software for your own personal or internal use only. Sharing a hyperlink to Licensor’s official website is permitted.

4. Commercial rights reserved

Licensor exclusively reserves the right to sell, license, and otherwise commercially exploit the Software. Nothing in this license grants you any right to resell the Software or to distribute it as a product or paid service.

5. Third-party material

The Software may include or depend on Apple frameworks and other components governed by their own licenses. Those licenses control those components.

6. No warranty

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. YOU USE THE SOFTWARE AT YOUR OWN RISK.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE, INCLUDING ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Termination

This license continues until terminated. It terminates automatically if you breach it. Upon termination you must stop using the Software and destroy all copies in your possession or control. Sections 1, 4, 6, 7, 8, and 9 survive termination.

9. General

If any provision of this license is held unenforceable, the remainder remains in effect. This license is the entire agreement between you and Licensor concerning the Software and supersedes any prior proposal or understanding relating to it. Licensor may update these terms for future versions of the Software. This license is governed by the laws of Norway, excluding its conflict-of-laws rules.
